EPA Rescinds 2022 PFAS Guidance for Permitting

In August 2026, the U.S. EPA rescinded a 2022 nonbinding guidance document that had provided state permitting authorities with standard language for addressing PFAS in National Pollutant Discharge Elimination System (NPDES) permits. This action was described as part of a broader, systematic review of agency guidance documents.

The rescission of this guidance has drawn attention because it removes a framework that some states used to begin addressing PFAS contamination from industrial sources, such as landfills and manufacturing plants. The EPA stated that the move was intended to reduce confusion as it prepares to propose new, binding Effluent Limitation Guidelines (ELGs) for industrial PFAS discharges. Industry stakeholders and environmental advocates are closely watching how this change impacts state-level permitting decisions in the interim. The agency has signaled that it intends to move toward formalized, sector-specific regulations to address PFAS in wastewater, rather than relying on nonbinding memos.
